These Terms and Conditions define the general conditions, rules, and methods of sales conducted by SMARTLINE GROUP SP. Z O.O. with its registered office in Warsaw, at ul. Konduktorska 18, unit 7, 00-775 Warsaw, NIP: 5214078410, KRS: 0001117189, hereinafter referred to as the "Seller," through the online store maracatu.pl (hereinafter referred to as the "Online Store").
These conditions apply to all contracts concluded through the website www.maracatu.pl after written acceptance by the owner of maracatu.pl. These conditions take precedence over any written or printed formalities by the buyer. By confirming the order, the buyer agrees to the current conditions. Any appendices to these general conditions will only be valid after written acceptance by the owners of www.maracatu.pl.
Orders are placed on the website www.maracatu.pl. The buyer will receive an email confirming the purchase. Special offers indicated on the website are not binding. They become binding only after order confirmation.
The placement of an order by the Customer constitutes an offer to the Seller to conclude a contract of sale for the goods that are the subject of the order.
Orders can be placed 24 hours a day, 7 days a week, throughout the year.
After placing an order, the Seller sends a confirmation of the order placement by the Customer to the email address provided by the Customer. The contract is concluded when the Seller sends the order confirmation to the Customer.
Maracatu.pl makes deliveries throughout Poland via courier companies and the Polish Post.
Delivery is free throughout Poland for all orders with a value above 199 zł. For orders below 199 zł, shipping costs are 15.90 zł.
For all payment methods (except cash on delivery), shipping of goods occurs only after receiving payment. In the case of cash on delivery payment, shipping occurs immediately after receiving the order.
The estimated delivery time is always indicated in the shopping cart. In case of force majeure, the owner of www.maracatu.pl has the right to verify and change the situation without judicial intervention, delay delivery until the cause of force majeure is removed, without the buyer having the right to demand a refund.
An invoice is attached to all orders.
Delivery time applies to all orders placed before 2:00 PM. Orders placed after 2:00 PM are treated as placed on the next business day. Delays are possible due to force majeure (independent of maracatu.pl or the courier).
These terms are valid for orders paid by card, Apple Pay, Google Pay, BLIK, Przelewy24, and cash on delivery. For orders with bank transfer payment, the delivery time refers to the moment when maracatu.pl receives payment confirmation from the bank.
If a product is temporarily unavailable in stock, maracatu.pl will indicate this directly on the website. If despite our attention you purchase products that are temporarily unavailable, you will be immediately notified via email or phone. New delivery dates will be provided.
Product prices listed on the maracatu.pl website are guaranteed, except in cases of force majeure. Prices are given in PLN and include VAT. Shipping costs are not included (except for minimum purchase amounts where delivery is free).

Online transactions take place in secure SSL (Secure Socket Layer) mode and are processed through the Przelewy24 system. We accept payments made with: Visa / Mastercard / American Express.
Online payments are processed through the Przelewy24 platform. The owner of the platform is PayPro SA with headquarters in Poznań, ul. Kanclerska 15, 60-327 Poznań, NIP: 779-236-98-87, REGON: 301345068.
Check carefully the delivery address provided during order placement. In case of providing an incorrect address, the Seller is not responsible for non-delivery or delay in delivery of the order.
It is not possible to refuse acceptance of a package with payment on delivery when it has already been sent. It is possible to cancel the order by contacting Customer Service only before shipment. In case of refusal/non-acceptance of the package from the courier, the recipient will have to cover all due costs (shipping cost, return cost, and storage).
An Internet purchase is a real sales contract.
In case of direct refusal to accept the package at the time of delivery OR NON-PAYMENT, you will be notified by email or phone for clarification. If we do not receive a telephone or email response within 10 days, we will return the shipment and you will be charged the total cost of the shipment itself, as well as the cost of return to the sender and storage, according to the conditions of which you will be informed.
If the package is rejected, all shipping costs remain the responsibility of the ordering customer and are charged with the costs of return to the sender and storage in the amount of an additional 60 zł. You will be expressly asked to pay the amount within a specified time.
In case of non-payment, the case will be transferred to our lawyers for debt collection.
The Seller ensures the delivery of Goods free from physical and legal defects. The Seller is responsible to the Customer if the Goods have a physical or legal defect (warranty).
Complaints regarding the warranty for defects in the Goods may be submitted electronically to the address: biuro@maracatu.pl or in writing to the address: ul. Konduktorska 18, unit 7, 00-775 Warsaw.
Complaints are processed within 14 days from the date of receiving the complaint notification. The Customer will be informed of the result of the complaint consideration electronically or in writing.
In case of accepting the complaint, the Seller, according to the Customer's choice, will replace the defective Goods with ones free from defects or remove the defect. If the Seller is unable to replace the Goods or remove the defect, the Customer has the right to demand a price reduction or withdraw from the contract.
The warranty is provided for in the Civil Code and protects the consumer in case of purchasing defective products that operate improperly or do not correspond to the use declared by the seller. The consumer, in case of receiving defective or damaged goods, can assert their rights under the warranty directly from the seller of the purchased product.
Products purchased on the website www.maracatu.pl will be delivered according to the information provided by the buyer. By accepting these purchase conditions, the buyer confirms this assumption. Maracatu.pl guarantees the quality and effectiveness of the delivered products, in accordance with the manufacturer's information in the CE. Products purchased on www.maracatu.pl are in the original packaging (blister or flowpack). External packaging is created by maracatu.pl, ensuring safe and protected packaging of goods.
The buyer undertakes to carefully read the instructions and conditions of use before using the products. In case of doubt, the buyer undertakes to contact the manufacturer before using the product. The owner of the website is not responsible for any technical defects of the packaged product or any erroneous indications in the manufacturer's conditions. The owner of www.maracatu.pl cannot be held responsible for the buyer's non-recognition of the taste/aroma/consistency/appearance of the purchased product or for any product intolerances. Maracatu.pl is also not liable if the defect results from neglect of maintenance, intentional deterioration, or negligent application of the manufacturer's instructions and conditions.
For purchases of devices and/or accessories made via the Internet, call center, and outside commercial premises, it will always be possible to exercise the right of withdrawal from the contract in accordance with what is specified in the Consumer Rights Act, within 14 calendar days from the delivery of the goods (or the last goods in case of multiple orders), by sending an email to info@maracatu.pl to obtain information on the method of return.
The goods should be returned at the expense and risk of the consumer within 14 days of receiving the goods to the address:

Only returns of goods in perfect condition and in the original packaging, together with the appropriate purchase invoice, will be accepted.
If returns have been made according to the above description, maracatu.pl will make a refund or credit to the customer for future purchases, within a maximum period of 14 days from the moment it learned of the withdrawal from the contract. Maracatu.pl may withhold reimbursement until it receives the goods. The costs of return are borne by the sender. The consumer is only responsible for the reduction in the value of the goods resulting from handling them in a way other than necessary to establish the nature, characteristics, and functioning of the goods.
With the exception of products covered by Art. 38 of the Consumer Rights Act, the right of withdrawal from the contract does not apply to the consumer in relation to the following contracts:
According to the Consumer Rights Act, the return of food products such as: capsules, sachets, cookies, chocolate, or sugar will therefore not be accepted. Exceptions are cases in which anomalies (crushed and/or missing parts of capsules, packaging defects, etc.) cannot be determined by the customer at the time of purchase: in this case, exchanges will be accepted after verification by maracatu.pl.
Personal data that the buyer provides on the website www.maracatu.pl as part of an order are stored in a computerized customer database. The owner of maracatu.pl uses this information exclusively to transmit information to the buyer and to process orders. Commercial communication (sending Newsletters) takes place only after voluntary and explicit consent of the user. The buyer can change and delete this information at any time. Personal data will never be transferred to third parties.

In matters not regulated in these Terms and Conditions, the generally applicable provisions of Polish law apply, in particular: the Civil Code, the Act on the Provision of Electronic Services, the Consumer Rights Act.
For all disputes that may arise, the court with jurisdiction is the court competent for the seller's headquarters.
